1. Business use and eligibility
You must be at least 18 years old and able to enter into a binding agreement. ProfitWatch is intended for business and professional use, including commercial cleaning companies and their authorized personnel.
2. The service
ProfitWatch provides account-level profitability calculations, historical tracking, scenario modeling, scope and pricing tools, and related decision-support features. Features may be added, changed, improved, or removed as the product evolves.
3. Your data and responsibilities
You retain ownership of the business data you enter. You grant ProfitWatch permission to host, process, calculate, display, and back up that information solely as needed to provide, secure, support, and improve the service. You are responsible for the accuracy of your inputs, maintaining the confidentiality of your login credentials, and ensuring that you have the right to enter any information you provide.
4. Profitability estimates and business decisions
ProfitWatch is a decision-support tool, not an accounting system, payroll provider, tax service, legal service, or financial adviser. Results depend on the assumptions and data entered by the user. Contribution, margin, pricing, labor, and recovery calculations are estimates and do not guarantee profitability, savings, customer acceptance of a price increase, or any other business outcome. You remain responsible for business decisions made using the service.
5. Subscriptions and billing
Paid subscriptions renew automatically according to the plan selected unless canceled. Subscription checkout, payment processing, taxes, receipts, and related billing functions are handled by Lemon Squeezy. Their applicable checkout and payment terms may also apply. Pricing and plan features shown at the time of purchase govern your subscription unless we notify you of a change as required by law.
6. Cancellation
You may cancel a paid subscription through the customer billing portal when available in your ProfitWatch workspace. Cancellation stops future renewal; access may continue through the remaining paid period depending on the subscription status shown in your account. 7. Acceptable use
You may not misuse the service, attempt to access another customer’s workspace, interfere with service security, reverse engineer protected portions of the service except where law permits, use the service to distribute malware or unlawful material, or use automated methods that materially disrupt the service.
8. Availability and changes
We work to keep ProfitWatch available and reliable, but uninterrupted or error-free operation is not guaranteed. Maintenance, third-party outages, security events, or product changes may temporarily affect availability.
9. Intellectual property
ProfitWatch, its software, product design, branding, calculations, documentation, and original content are owned by the operator of ProfitWatch or its licensors, excluding customer data and third-party materials. These Terms give you a limited, non-exclusive, non-transferable right to use the service during your authorized access period.
10. Disclaimer of warranties
To the maximum extent permitted by law, ProfitWatch is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or guaranteed business results.
11. Limitation of liability
To the maximum extent permitted by law, ProfitWatch and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the service. To the extent liability cannot be excluded, total aggregate liability relating to the service will not exceed the amount you paid for ProfitWatch during the twelve months preceding the event giving rise to the claim.
12. Termination
We may suspend or terminate access for material violation of these Terms, fraud, abuse, security risk, nonpayment, or unlawful use. You may stop using the service at any time, subject to the subscription-cancellation provisions above. Workspace owners may permanently delete their ProfitWatch workspace and login after canceling any actively renewing subscription.
13. Governing law
These Terms are governed by the laws of the State of Nebraska, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms as the service changes. Material updates will be published with a revised effective date and, when legally required, additional notice.
